TRI365 is operated by Emo Enterprises Pty Ltd (ABN 47 602 823 852), an Australian online retailer of triathlon and endurance sports gear ('TRI365', 'we', 'us', 'our'). This Privacy Policy explains how we collect, use, store and disclose your personal information when you visit tri365.com.au, buy from us, contact us or sign up to our emails. We handle personal information in line with the Australian Privacy Principles in the Privacy Act 1988 (Cth).

1. What personal information we collect

Depending on how you deal with us, we may collect:

  • Contact details: your name, email address, phone number and postal address.
  • Order details: billing and delivery addresses, products purchased, order history, returns and exchanges.
  • Account details: your login details and saved preferences, if you create an account.
  • Fit and product information you choose to share: for example shoe size, wetsuit size, height or weight when you ask us for sizing advice.
  • Customer support information: anything you include in emails, contact forms or messages to us.
  • Reviews and feedback: product reviews, survey answers or testimonials you submit.
  • Device and usage information: your IP address, browser and device type, pages viewed, products added to cart and how you reached our site.

Payment details: card and payment details are entered directly into our payment providers' secure systems. We do not see or store your full card number.

You can browse our site without giving us your name. However, we need certain information to process an order, deliver it or reply to you.

2. How we collect it

  • Directly from you, when you place an order, create an account, contact us, enter a promotion or subscribe to our emails.
  • Automatically, through cookies, pixels and similar technologies when you use our site or open our emails (see section 5).
  • From service providers who help us run the store, such as Shopify, payment providers and delivery companies, for example delivery tracking updates.

3. Why we use it

  • To process, deliver and support your orders, returns, exchanges and warranty claims.
  • To answer your questions and give product and sizing advice.
  • To manage your account.
  • To send you marketing emails or messages, if you have agreed to receive them (see section 4).
  • To understand how people use our site so we can improve it, our range and our advertising.
  • To detect and prevent fraud, misuse and security issues.
  • To meet our legal obligations, including tax, consumer law and record-keeping requirements.

4. Marketing emails and messages

We only send marketing emails or SMS if you have agreed to receive them, for example by ticking the box at checkout or signing up to our newsletter. Every marketing message identifies TRI365 and includes a simple way to unsubscribe. You can opt out at any time by clicking 'unsubscribe' or emailing us. We will still send you messages about your orders, such as confirmations and delivery updates.

5. Cookies and similar technologies

We and our service providers use cookies, pixels and similar technologies to keep our site working (for example, to remember your cart), to understand how the site is used, and to show you more relevant ads on other websites and social media. Our store runs on Shopify; you can read about the cookies Shopify uses at shopify.com/legal/cookies.

You can block or delete cookies in your browser settings. Some parts of the site, such as the cart and checkout, may not work properly without them. To limit how Shopify uses your information for advertising across other Shopify stores, visit privacy.shopify.com.

6. Who we share it with

We do not sell your personal information. We share it only where needed to run our business, with:

  • Shopify, which hosts our online store and stores order and customer data;
  • payment providers, to process payments and prevent fraud;
  • delivery providers, such as Australia Post, to deliver your order;
  • email, review, analytics and advertising providers that help us communicate with you and improve our site;
  • our related businesses, where needed to provide our services;
  • professional advisers, such as accountants and lawyers;
  • government or law enforcement bodies, where required or authorised by law; and
  • a buyer of our business, if all or part of the business is sold.

These providers may only use your information to provide services to us or as described in their own privacy policies.

7. Overseas disclosure

Some of our service providers store or process information outside Australia. For example, Shopify and some email, analytics and advertising providers store data in countries including Canada, the United States and countries in Europe. We take reasonable steps to ensure these providers handle your information in a way that is consistent with the Australian Privacy Principles.

8. Keeping your information secure

We take reasonable steps to protect your personal information from misuse, interference, loss and unauthorised access or disclosure. These steps include using reputable, secure platforms and limiting who in our team can access customer data. No online service is completely secure, so please use a strong password for your account and do not send card details to us by email.

We keep personal information only for as long as we need it for the purposes above, or as required by law. For example, we keep transaction records for tax purposes. After that, we securely delete or de-identify it.

9. Accessing and correcting your information

You can ask for a copy of the personal information we hold about you, or ask us to correct it, by emailing hello@tri365.com.au. We may need to confirm your identity first. We will respond within 30 days. If we cannot give you access or make a correction, we will tell you why. You can also ask us to delete your account and marketing data, unless we need to keep it for legal reasons.

10. Children

Our site is intended for adults. We do not knowingly collect personal information from children under 16 without the consent of a parent or guardian. If you believe a child has given us their information, please contact us and we will delete it.

11. Complaints

If you have a concern about how we have handled your personal information, please email hello@tri365.com.au with details. We will look into it and respond within 30 days. If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au or on 1300 363 992.

12. Changes to this policy

We may update this Privacy Policy from time to time. When we do, we will post the new version on this page and change the 'Last updated' date at the top.
